Welcome to Easy Workshop Management System. These Terms and Conditions govern your use of our SaaS product and services.

1. Eligibility

Our services are primarily intended for use by businesses, particularly workshops. By agreeing to these Terms, you represent that you are legally eligible to enter into a binding contract in your jurisdiction.

2. Free Trial and Subscription

  1. Eligibility for Trial: We offer new users a complimentary 14-day trial period to experience our services. This trial is intended to allow you to evaluate the service before committing to a subscription.
  2. Subscription Requirement: Upon the conclusion of the free trial, continued access to our service is contingent upon subscribing to our annual plan. Subscription and payment processes are managed securely through Stripe , our trusted payment gateway partner.
  3. Non-Refundable Fees: Please note that all subscription fees are final and non-refundable, underlining the importance of evaluating the service during the free trial period.

3. Account Registration

  1. Accuracy of Information: Users are required to provide true, accurate, and complete company information during the registration process, including but not limited to company name, registration number, contact details, and address.
  2. One Account Per Company Policy: Each account should represent a single company entity. Separate accounts are required for distinct company entities to ensure the integrity and security of our service.

4. Intellectual Property

  1. Ownership and Rights: All logos, software, and materials provided as part of the Easy Workshop Management System are the exclusive intellectual property of our company.
  2. Prohibition of Unauthorized Use: The unauthorized use, reproduction, modification, or distribution of our intellectual property is strictly prohibited and may be subject to legal action.

5. User Content

  1. Purpose of Content: Users are permitted to upload their business logos for professional use within the system.
  2. Compliance with Laws: All user content must adhere to applicable laws and regulations. Users are responsible for ensuring that their content does not infringe on the rights of others or violate any legal statutes.

6. Privacy Policy

  1. Commitment to Data Privacy: We are committed to protecting the privacy of our users. The personal information collected is exclusively for business-related purposes and is safeguarded in accordance with the Personal Data Protection Act (PDPA) of Malaysia.
  2. Accessibility of Privacy Policy: Our comprehensive Privacy Policy, which outlines our data collection, use, and protection practices, is available for review on our website.

7. Limitation of Liability

Nukmans Technologies Enterprise employs reasonable measures to protect the security of your data. However, given the nature of the internet and the possibility of unforeseen security breaches, we cannot guarantee complete security of any data transmitted to or from our service. Therefore, Nukmans Technologies Enterprise is not liable for:

  1. 1. Any unauthorized access to, alteration of, or the deletion, destruction, damage, loss, or failure to store any of your data or other content.
  2. 2. Indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of our service.

Nukmans Technologies Enterprise will strive to maintain the integrity and security of your data but cannot assure absolute security, and we recommend users to also take proactive measures to protect their data.

8. Termination

  1. Right to Terminate: We reserve the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
  2. Account Sharing: Accounts identified as being shared among different companies will be terminated immediately. Please note that in such cases of termination, there will be no refunds for any subscription fees already paid.
  3. Effect of Termination: Upon termination, your right to use the services will cease immediately. It is your responsibility to ensure that any content or data stored within our service is appropriately backed up.

9. Governing Law

  1. Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
  2. Legal Compliance: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Amendments to Terms

  1. Right to Amend: We reserve the right to modify or replace these Terms at any time, at our sole discretion.
  2. Notice of Amendments: We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
  3. Acceptance of Revised Terms: By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
